COLLAR offers and sells on this website www.collarpainter.com (hereinafter the 'Website'), directly to its consumers, products from the Collar and Collar Atelier collections (hereinafter the 'Products' or 'Product'). The sale of Products on the Site is subject to these terms and conditions of sale (hereinafter the "Terms and Conditions of Sale"). The Products presented on the Site are sold by Collar.

2.1. The Products presented on this Site are offered for sale to consumers, natural persons of legal age (hereinafter the "Consumers" or the "Consumer") acting for purposes other than the commercial, craft, entrepreneurial or professional activity that they may be engaged in. Products may not be purchased by individuals under the age of 18 without the permission and supervision of a parent or guardian. COLLAR does not knowingly collect personal information on the Site from or about minors. The purchase of Products offered will only be possible for shipment to the countries indicated on the Site.

2.2. Before confirming and sending the purchase order, the Consumer must carefully read these Terms and Conditions of Sale, which can also be viewed and downloaded from the Site and/or by e-mail which COLLAR will send to the Consumer in accordance with the provisions of Article 3.6 below. The Terms of Sale and the Privacy Notice (hereinafter "Privacy Notice") constitute the terms and conditions governing the contract between the Consumer and COLLAR entered into at a distance through the use of the Website.

3.1. The Site shows, for each Product selected, an image of the Product in question, the unit price, color and sizes, and the images are used for the sole purpose of illustrating the Product; COLLAR shall not, therefore, be liable for any inappropriate graphic representation of the Products shown on the Site.

3.2. The Consumer will be able to select the Product(s) of interest to him/her, including the relevant color and size. The Product selected for purchase will be loaded into the "shopping cart". It is not possible to select a Product by loading it into the "shopping cart" and save it to proceed with the purchase in a later Internet session. If the purchase procedure is not completed, the contents of the shopping cart will be deleted. The sales process will be deemed to have been completed when COLLAR receives the Purchase Order by telematic means, after checking that the order details have been correct.For products where personalisation is possible, in order to proceed with personalisation, the Consumer will need to submit an alphanumeric combination which will be carried out by us on the selected product. By submitting such a combination, the Consumer expressly guarantees that:

- it does not contain expressions that may be obscene, offensive, discriminatory or contrary to public policy; and

- it does not violate any applicable law or any right or interest of any third party; Consumer shall be solely and exclusively responsible and liable for such provisions.

We reserve the right, in our sole discretion, not to accept a proposed combination, e.g., if it may be offensive or contain trademarks or copyrights of third parties, although we have no obligation to verify the submitted combination. Please note that the right of withdrawal does not apply in case of customized products.

3.3. To proceed with the purchase of the Products, the Consumer must complete and send to COLLAR the form with the order proposal in electronic format (hereinafter "Order Form"), following the instructions provided on the Site. The Consumer will have to introduce the Product in the "basket" and, after having read and accepted the General Conditions, the summary of the information on the essential characteristics of each ordered Product, the detail of the expenses of delivery, the conditions on the right of withdrawal ("the Note of information on the Right of Withdrawal"), as well as the Note of information on the Protection of the personal data, it will have to select the method of payment and to choose the option "to buy".

3.4. With the telematic transmission of the Purchase Order, the Consumer accepts and commits himself to respect, in the execution of the contract with COLLAR, the present Conditions of Sale. For the purposes of transmitting the Purchase Order for the purchase of Products on the Website, the Consumer must accept these Terms and Conditions.

3.5. If the Consumer needs to correct any data entry errors, he/she must follow the modification procedure indicated on the Site, before sending the Purchase Order. By sending the Purchase Order, the Consumer acknowledges and declares that he/she has taken note of all the information provided during the purchase procedure and fully accepts the General Conditions, as they are binding once the purchase is concluded.

3.6. At the end of the purchase procedure, COLLAR advises to save or print the Terms and Conditions of Sale, the Information Note on the Protection of Personal Data and the Information Note on the Right of Withdrawal. The Consumer will receive an email at the address indicated in the Purchase Order as confirmation of the order placed, acceptance of the Privacy Notice and the Right of Withdrawal Notice and the Terms and Conditions of Sale, which the Consumer will receive as an attachment to the said email. The Purchase Order will be archived in COLLAR's database in Hanover for at least the time necessary to process the orders and in any case within the time limits and under the conditions provided by law.

3.7. COLLAR reserves the right to refuse orders placed by purchasers whom it does not consider suitable or with whom there is a dispute concerning a previous order or any other legitimate reason, without any need to provide reasons. COLLAR reserves the right to restrict or not to fulfil orders which, in its absolute discretion, appear to be placed for commercial and/or business purposes.

4.1. COLLAR does not guarantee the availability of the articles offered on the Site, those being subjected to limits of stock. The Consumer is invited to check the availability of the articles offered on the Site at the time of the purchase.

4.2. In the event of temporary unavailability of certain Products ordered, COLLAR will inform the Consumer within 5 working days (and in any event within the delivery period stated below) by email or telephone. If the Product(s) is (are) not available, no amount will be debited to the payment method used by the purchasing Consumer. If the amount of the purchase has already been debited, the corresponding amount will be refunded within 30 days.

5.1. The order process is complete when the selection of the "buy" option has taken place. Upon confirmation of the Purchase Order, the order will be sent to COLLAR for processing and cannot be changed or cancelled.

5.2. Confirmation of the order will be deemed to be evidence of the Consumer's acceptance of the provisions set out in these Terms and Conditions of Sale, the Privacy Notice and the Right of Withdrawal Notice. The data recorded by COLLAR on its server will be treated as evidence of the transaction between the Consumer and COLLAR.

6.1. The prices of the Products available for sale will be quoted in Canadian dollars. While we endeavour to ensure that all prices on the Site are accurate, errors may occasionally occur. If there is an error in the price of the goods in the confirmed order, COLLAR will give the Consumer the opportunity to re-confirm the order at the correct price or to cancel it. If COLLAR is unable to contact the Consumer, it will treat the order concerned as cancelled.

6.2. The amount shown at the end of the purchase process, before the order is confirmed, also includes the shipping costs.

6.3. Payment can be made by bank transfer or Paypal.

6.4. The Products purchased will only be dispatched after the Consumer's credit card details have been checked and only after the debit authorisation has been received from your bank, it being understood that the debit will only take place after the Products ordered have been dispatched. COLLAR also reserves the right to check the Consumer's credit card and/or Paypal account details even after the purchase has been made if there are any anomalies in the transaction or if there is any doubt about fraudulent and/or unauthorised use of the payment method.

7.1. The Products will be delivered to the address provided at the time of completing the Purchase Order. For security reasons, COLLAR cannot ship the Product purchased to a PO Box or accept an order that does not identify the recipient of the order and their address.

7.2. Shipping costs are the responsibility of the Consumer and are set out separately in the Purchase Order and in the relevant invoice.

7.3. All purchases will be delivered by a selected courier service (e.g. UPS Express) (hereinafter, "Courier Service") between Monday and Friday, excluding Saturdays, Sundays and local or national public holidays, from the day after the confirmation of the Purchase Order and in any event within 10 (ten) working days of the confirmation of the Purchase Order, based on the availability indicated. COLLAR is not responsible for delays that are unforeseeable and/or attributable solely to the Courier Service.

7.4. In the event of any problems or delays in delivery which exceed 10 (ten) working days from the confirmation of the Purchase Order, Consumers are requested to inform COLLAR using the email address set out in the 'Contacts' section of the Site. COLLAR reserves the right not to respond to complaints sent more than 30 (thirty) days after acceptance of the Purchase Order.

8.1. COLLAR may make changes or corrections to these Terms of Sale, the Privacy Statement and the Products and their prices at any time without notice. The Consumer must carefully check the Terms of Sale and the Privacy Policy each time he or she uses the Website to make a purchase.

8.2. Occasionally, there may be typos, inaccuracies or omissions on the Website (collectively referred to as 'Errors') in relation to the description of the Product, the price, any promotions, offers and availability of the Product. COLLAR reserves the right, at any time and without notice, to correct such Errors, to amend or update information, to revoke any offer containing such Errors, and to cancel any order at any time prior to despatch, including after an order has been submitted and even if the Purchase Order has been confirmed and the relevant amount debited to the payment method used for the purchase.

8.3. The aforementioned changes and/or corrections will only be considered valid for purchase orders sent after the date of the change or correction made by COLLAR. In particular, the Consumer will be charged the prices that appear on the Website at the time of confirmation of the Purchase Order, provided that the Products ordered are available at that time.

9.1. The delivered Products must be checked by the Consumer at the time of delivery to ensure that they correspond to the Products ordered.

9.2. Any anomalies noted at the time of delivery (e.g. alterations or damage to the packaging, damaged Products, items missing from the delivery note, items not conforming to the items ordered, etc.), may be indicated by the Consumer directly to the courier service, by placing a handwritten and signed comment on the delivery note. In this case, the Consumer will not be required to accept the Products and may return them directly to the courier service.

9.3. In the event of anomalies (e.g. alterations or damage to the packaging, damaged Products, items missing from the delivery note, items not conforming to the items ordered, etc.), noted after delivery, the Consumer must inform the courier service as soon as possible in the "Contacts" section of the Site.

10.1. We do not accept returns or refunds on purchased items.

11.1. The Products offered for sale on the Site are provided on an 'as available' basis. COLLAR makes no warranties, express or implied, beyond the description of the Products set out in the Order Confirmation; in particular, COLLAR makes no warranties, express or implied, (i) as to the operation or content of the Site, (ii) that the Site and the servers that host it are free from viruses, or that emails are free from viruses, or (iii) that information collected on the Site is completely secure from access by hackers and other unauthorised users.

COLLAR expressly disclaims any duty to update or revise the materials on the Site. The Consumer assumes full responsibility for any risks associated with the use of the Site.

12.1. All content on the Site www.collarpainter.com such as trademarks, copyrights, corporate images, works, pictures, photos, dialogue, music, sounds, videos, documents, drawings, figures, logos, menus, web pages, graphics, colors, diagrams, tools, typefaces, designs, layouts, methods, processes, functions and software (collectively, the Content), is owned and exclusively available to COLLAR or its content providers and is protected by copyright and other intellectual property laws.

12.2. Consumer may not reproduce, publish, distribute, display, modify, create derivative works from, or in any way exploit, in whole or in part, any of the Content without the prior written consent of COLLAR, or its content providers, as the case may be. Except, however, where COLLAR hereby grants Consumer permission, for its exclusive and non-commercial use, to display, download and print in hard copy the pages of the Site.

12.3. COLLAR has the right at any time to claim ownership of any Content published on the Site and to object to any use, distortion or other modification of that Content.

13.1. COLLAR reserves the right to change, suspend or discontinue the operation of the Site or its contents at any time without notice.

14.1 For any complaint, additional information or assistance on the Site or on the purchase procedure, the Consumer is requested to send an e-mail to the address indicated in the section "Contacts" of the Site.
